Preamble – Scope of Application
These General Terms and Conditions govern access to and use of the website https://www.nanipets.com/it and regulate all sales concluded through this platform.

By browsing the website, creating an account or placing an order, the user automatically accepts these General Terms and Conditions and undertakes to comply with them in full.

The website is operated by:

These Terms apply to consumers resident in Switzerland, the European Union and non-EU countries, according to the distinctions set out in the following provisions.


PART I — GENERAL PROVISIONS

Art. 1 – Recipients of the Service and Personal Scope

1.1 Personal scope
These General Terms and Conditions govern the contractual relationship between Nani – Fatti per stare insieme and the persons who purchase products on the website https://www.nanipets.com/it, distinguished into the categories indicated below.

1.2 Consumers
For the purposes of this document, “Consumer” means any natural person who purchases the products for purposes unrelated to any commercial, entrepreneurial or professional activity that may be carried out.

A) Consumers resident in Switzerland
Sales are governed by Swiss law.
No statutory right of withdrawal applies.
Only the internal return policy described in the “Returns and Refunds” section shall apply.

B) Consumers resident in the European Union
The protections provided for by Directive 2011/83/EU apply, including the right of withdrawal within 14 days, as detailed in the section “LEGAL INFORMATION — RIGHT OF WITHDRAWAL (EU)” of this document.

C) Consumers resident in non-EU countries
The protections provided for under EU legislation do not apply.
Return requests are handled in accordance with the internal company policy set out in the “Returns and Refunds” section.

1.3 Professional customers (B2B)
The protections afforded to Consumers do not apply to professional customers, companies, resellers or persons who purchase in the context of their business or economic activity.
For such customers, only these General Terms and Conditions shall apply and, for matters not provided for herein, the applicable corporate and commercial law.


Art. 2 – Subject Matter of the Contract

2.1 Subject matter
The website advertises and sells leather goods, accessories and jewellery.

2.2 Product information
Prices, features and availability of the products are indicated in the relevant product sheets.

2.3 Online representations
Online representations of the products (photographs, videos, colours, graphics or multimedia elements) are for illustrative purposes only and do not constitute a binding guarantee as to the final characteristics or shades of the product, which may vary due to the artisanal production process, the natural leather used or the settings of the device used by the Customer.


Art. 3 – Purchase Process

3.1 Stages of the purchase process
The purchase process includes the following steps:

  1. Selection of the products and verification of the technical information;

  2. Placement of the order on the website;

  3. Payment via one of the available methods (card, PayPal, Klarna, Apple Pay);

  4. Automatic order confirmation by e-mail;

  5. Shipment of the item via tracked courier.

3.2 Perfection of the sale
The sale is deemed to be perfected only upon successful completion of payment, as specified in Art. 5.


Art. 4 – Prices and Customs Rules

4.1 Switzerland
Prices are expressed in CHF and include Swiss VAT, where applicable.

4.2 European Union
For orders destined for countries within the European Union, the following conditions apply:

a) Orders of an amount equal to or greater than EUR 120 / CHF 120
Shipment shall be carried out under DDP (Delivered Duty Paid) terms.
This means that all import costs (customs duties, local VAT and customs clearance fees) are fully borne by the Seller, with no additional charges for the Customer upon delivery.
The applicable charge is included in the final price shown at checkout.

b) Orders of an amount below EUR 120
Shipment shall be carried out under DAP (Delivered At Place) terms.
In this case, customs duties, VAT of the country of destination and customs clearance fees are borne by the Customer and will be charged by the courier upon delivery.
Consequently, the total cost of the order may be higher than the price displayed on the website.

c) Transparency of import charges
The total amount effectively payable by the Customer under DAP terms may vary depending on:

• the VAT rate applicable in the country of destination;
• the customs duty applicable to the product category;
• any administrative costs charged by the courier (e.g. customs clearance fees);
• the declared value of the goods.

4.3 Non-EU countries
For non-EU countries, shipment is carried out under DAP (Delivered At Place) terms.
All customs, tax and customs clearance costs are borne by the Customer.

4.4 Vouchers and discounts – General principle
The Owner reserves the right to verify the correct use of vouchers and to cancel them in the event of abuse, improper use, non-permitted cumulative use or breach of these Terms.
Vouchers are not cumulative, unless otherwise expressly indicated.

4.5 Rules on the use of vouchers
Vouchers, discount codes or promotional codes made available by the Owner are subject to the following conditions, unless otherwise expressly indicated:

• each voucher is valid exclusively within the period indicated on the website or on the voucher itself;
• vouchers cannot be combined with one another, unless otherwise authorised;
• the voucher must be used in a single transaction and does not entitle the holder to partial refunds where the order amount is lower than the value of the voucher;
• single-use vouchers may only be used once per Customer or per order;
• the Owner may revoke or refuse the application of a voucher in the event of abuse, improper use, breach of the applicable conditions or unlawful activity;
• the Customer may not claim refunds or credits in relation to expired or unused vouchers.


Art. 5 – Payments

5.1 Accepted payment methods
The Customer may make payment using the methods available at the time of purchase, including:

• credit and debit cards (Visa, MasterCard, American Express);
• PayPal;
• Klarna (where available in the Customer’s country);
• Apple Pay;
• any other methods indicated at checkout.

The Owner reserves the right to add, suspend or modify the available payment methods.

5.2 Security of transactions
Transactions are processed through certified third-party providers (e.g. Shopify Payments, PayPal, Klarna), which handle payment data via secure and encrypted connections.
The website https://www.nanipets.com/it does not store or process any payment card data, in compliance with:

• Swiss data protection law (FADP);
• the GDPR for EU Customers;
• the international PCI-DSS standard.

5.3 Payment confirmation and perfection of the order
The order shall be deemed perfected exclusively upon successful completion of payment.
If payment authorisation is not granted, the order will be automatically cancelled.
The Owner may carry out anti-fraud checks or request additional confirmations (e.g. verification of identity, billing address or card information) before accepting the order.

5.4 Failed or disputed payments
In the event of:

• rejected transaction,
• unauthorised payment,
• chargeback,
• dispute opened via the payment provider,

the Owner may suspend or cancel the order.

In the event of unfounded disputes, illegitimate chargebacks or fraudulent use of payment methods, the Owner reserves the right to charge the Customer the fees applied by financial intermediaries and any administrative costs borne for handling the dispute.

5.5 Currency and exchange rates
Orders are charged in the currency indicated at the time of purchase (CHF or EUR).
Any currency conversion, exchange fees or commissions are borne by the Customer and depend exclusively on the card issuer or payment provider.

5.6 Invoicing
The invoice is issued in electronic format and sent to the e-mail address provided by the Customer.
For purchases destined for the European Union, items relating to customs duties, VAT and customs clearance may be indicated separately, depending on whether DAP or DDP terms apply pursuant to Art. 4.


Art. 6 – Transfer of Title and Risk

6.1 Title
Title to the Products shall pass to the Customer upon successful completion of payment, i.e. at the time of confirmation of the transaction by the payment provider.
This principle applies by way of derogation from any different statutory or interpretative provision.

6.2 Risk during shipment

• For Customers resident in the European Union, the risk of loss or damage passes to the Customer only when the Product is physically received.
• For Customers resident in Switzerland and in non-EU countries, the risk passes to the Customer upon delivery of the goods to the carrier, unless otherwise agreed.

6.3 Risk in case of returns

• In the event of a return based on the right of withdrawal (EU), the Customer is responsible for the Product during transport until it is received by Nani.
• In the event of a return due to defect, the costs and risks of return are borne by the Owner, unless otherwise agreed.

6.4 Delivery to a courier chosen by the Customer
If the Customer requests the use of a courier selected by the Customer, the risk passes to the Customer at the time the Product is handed over to such carrier.


PART II — SHIPPING

Art. 7 – Shipping and Economic Conditions

7.1 Switzerland

• Free shipping on orders above CHF 20.
• A flat contribution of CHF 5 for orders consisting exclusively of small items (unless otherwise indicated in specific promotions on the website).

7.2 European Union

• Free shipping on orders above EUR 120 / CHF 120, under DDP terms.
• For orders below this threshold: shipment under DAP terms, with taxes and duties borne by the Customer, as described in Art. 4.

7.3 Non-EU countries
Shipment is carried out exclusively under DAP terms.
All duties, local taxes and customs clearance costs are borne by the Customer.

7.4 Shipping methods
All shipments are made via tracked service (Priority Plus or equivalent couriers) selected by the Seller.

7.5 Immediate inspection of the parcel
The Customer must photograph the packaging and contents and report any issues within 48 hours to support@nanipets.com.
Late reports or reports without supporting documentation will not be accepted.

The Customer may, at the time of delivery, add the wording “received subject to inspection” or similar where damaged or non-intact packaging is detected. Failure to add such reservation may limit the possibility of obtaining refunds from the carrier.

In the event of minor damage to the packaging that does not apparently affect the integrity of the contents, the carrier may refuse subsequent claims; however, the Customer is required to document any anomaly by means of photographs within 48 hours.


Art. 8 – Failed Delivery

If the parcel is not collected or cannot be delivered for reasons attributable to the Customer (incorrect or incomplete address, repeated absence, failure to collect from the collection point or similar), the shipment may be resent subject to payment of additional transport, storage and any return-to-sender costs.


PART III — WARRANTIES

Art. 9 – Statutory Warranty and Characteristics of Materials

9.1 Statutory warranty
The products are covered by a 24-month statutory warranty for manufacturing or conformity defects, within the limits and according to the legislation applicable in the Customer’s country of residence.

9.2 Defects covered by the warranty
The warranty covers, by way of example:

• structural defects;
• malfunctioning components;
• jewellery with defective stone settings not caused by impacts or falls;
• anomalies not attributable to normal use.

9.3 Exclusions from the warranty
The warranty does not cover:

• normal wear and tear;
• damage resulting from impacts, falls, salt water, chemicals or aggressive detergents;
• negligence or improper use;
• handling, tampering or modifications not authorised by Nani.

The product may be repaired, replaced or refunded after technical inspection, in accordance with the applicable law.

9.4 Characteristics of leather and artisanal materials
Nani – Fatti per stare insieme leather products are handcrafted by Italian artisans using vegetable-tanned leather straps produced according to traditional techniques. Slight variations in colour, grain, minor surface irregularities or colour shading do not constitute defects, but are natural characteristics of the material and of artisanal workmanship.

9.5 Characteristics of jewellery
The jewellery is made of hypoallergenic stainless steel with PVD coating free from nickel; the zircons are set in order to ensure durability and resistance. Minor differences in shade or micro-imperfections do not constitute defects but are the result of manual workmanship and the characteristics of the materials used.


PART IV — RETURNS AND REFUNDS

Art. 10 – General Conditions for Returns

10.1 Switzerland and non-EU countries
The Customer may request a return within 48 hours of delivery only in the following cases:

• defective product;
• size exchange;
• colour exchange.

The return must be authorised in writing by the Seller.
Once the return has been approved, the Customer has 30 (thirty) days to send the goods back.

For Customers in Switzerland, returns are free of charge.
For Customers in non-EU countries, the return shipping costs are borne by the Customer, unless otherwise agreed in the event of a proven defect.

Non-Returnable Requests / Returns Not Covered by the Policy
Requests for returns that do not fall within the cases expressly indicated above do not grant any right to a refund in cash.
Any acceptance of such return requests is at the sole discretion of the Seller and, if granted, may result exclusively in the issuance of a non-refundable store credit for a future purchase.
Shipping costs are always borne by the Customer.

10.2 European Union
Customers resident in the European Union are entitled to a statutory right of withdrawal within 14 days of delivery, under the conditions set out in the section “LEGAL INFORMATION — RIGHT OF WITHDRAWAL (EU)” of this document.

After this period, internal return rules apply:

• return at the Customer’s expense, unless in case of defect;
• obligation to declare “returned goods” for customs purposes in order to avoid duties for the recipient;
• prior authorisation required.

Once the 14-day period has expired, any return requests from EU customers will be assessed according to Nani’s internal return policy, with shipping costs borne by the customer unless defects of manufacture are found.

10.3 Minimum conditions for acceptance of returns (all countries)
The product must be:

• unused;
• free from signs of wear, scratches or stains;
• complete with box, pouches, tags, accessories;
• sent in a single shipment.

Returns will not be accepted if:

• sent without prior written authorisation (where required);
• damaged, altered or clearly worn;
• lacking the original packaging.

10.4 Non-returnable products
The following are in any case non-returnable:

• customised or engraved items;
• products on sale or promotion:
    – for Customers resident in Switzerland or in non-EU countries, no refund is provided; however, if the Seller accepts the return, a credit note may be issued for a future purchase;
    – for Customers resident in the European Union, the statutory right of withdrawal within 14 days remains applicable also to products purchased on sale or promotion, within the limits provided for by EU law;
• GIFT-SETS: partial returns are not permitted; the set must be complete and intact.


PART V — LIABILITY AND DISPUTES

Art. 11 – Limitations of Liability

11.1 Force majeure and third parties
The Seller shall not be liable for delays or failures in performance due to force majeure, nor for fraudulent use of payment methods by third parties, where all reasonably required security measures have been adopted.

11.2 Technical malfunctions
The Owner shall not be liable for malfunctions, interruptions or difficulties relating to the internet network, IT systems, payment platforms or technical causes not directly attributable to its control.

11.3 Limitation of compensation
If the order cannot be executed for reasons beyond the Owner’s control, the Customer shall only be entitled to a refund of the amounts paid, without any further indemnity or compensation.


Art. 12 – Complaints and Dispute Resolution

Complaints must be sent to the following e-mail address: support@nanipets.com.
The Seller undertakes to respond within 7 (seven) days from receipt of the communication.


Art. 13 – Governing Law and Jurisdiction

These Terms and Conditions are governed by Swiss law.
The court having exclusive jurisdiction shall be Vevey (VD), Switzerland, without prejudice to any different agreement between the parties and any mandatory provisions in favour of the EU Consumer.


Art. 14 – Severability Clause

The invalidity or ineffectiveness of any provision of these General Terms and Conditions shall not affect the validity of the remaining provisions, which shall continue to be fully effective.


Art. 15 – Personal Data Protection

The processing of personal data is carried out in compliance with the Swiss Federal Act on Data Protection (FADP).

Information on the methods and purposes of processing, data retention, security measures and user rights is contained in the Privacy Policy and Cookie Policy, which form an integral part of these General Terms and Conditions.

Nani – Fatti per stare insieme does not sell or transfer users’ personal data to third parties for purposes unrelated to the management of orders or of the website, except where required by law or upon request of the competent authorities.


Art. 16 – Intellectual Property and Website Content

All content on https://www.nanipets.com/it — including texts, photographs, images, logos, graphics, product descriptions, designs and multimedia materials — is protected by Swiss copyright law and by the Federal Act on the Protection of Trade Marks (LPM).

Use of the website implies acceptance of the provisions set out in the Legal Notice, which forms an integral part of these General Terms and Conditions and can be consulted at the following link:

Any reproduction, publication, distribution or use of the content without the prior written authorisation of the Owner is strictly prohibited.
Infringements may give rise to civil and criminal liability.


LEGAL INFORMATION — RIGHT OF WITHDRAWAL (EU)

Valid only for Consumers resident in the European Union.

• The Customer may withdraw from the contract within 14 days from delivery, without giving any reason.
• The communication must be sent exclusively by e-mail to support@nanipets.com, indicating the order number and identification details.
• The goods must be returned at the Customer’s expense, intact and in the complete original packaging, within 14 days from notification of withdrawal.
• The right of withdrawal also applies to products purchased on sale or promotion, without prejudice to the exclusions provided by law.
• The right of withdrawal does not apply to:
    o customised or made-to-measure products;
    o products that are damaged, clearly used or lacking the original packaging.

The refund will be made within 14 days from receipt and inspection of the goods, using the same payment method employed for the purchase, unless otherwise expressly agreed with the Customer.

Swiss and non-EU Consumers
The statutory right of withdrawal does not apply.
The internal return policy described in the “Returns and Refunds” section shall apply.
